On August 8, 2014, Litigation Member Tony Lathrop presented “Changing the Rules of Engagement: An Overview of Recent Amendments & Proposed Amendments to the Federal Rules of Civil Procedure” at the Network of Trial Law Firms Seminar in New York. Litigants face significant changes to several of the Federal Rules of Civil Procedure that are critical to navigating the federal litigation landscape, including the rules governing subpoenas, discovery, and spoliation sanctions.  Lathrop’s presentation addressed the long-awaited changes to Rule 45, which took effect on December 1, 2013 and streamlined the use of subpoenas in federal civil actions.  He also reviewed the pending proposed amendments to the rules governing discovery and spoliation sanctions, which seek to address the challenges of managing the scope of discovery in the digital age and the attendant consequences for a party’s failure to meet its discovery obligations.
