An Overview of Prejudgment Remedies in North Carolina   

Outline: This program will identify and explain various basic remedies available to secured creditors and other litigants in North Carolina prior to obtaining any court judgment awarding relief.  Topics discussed will include (i) self-help remedies against personal property collateral under the Uniform Commercial Code (prior to a foreclosure sale under Article 9), (ii) the statutory requirements and procedures for seeking claim and delivery relief to obtain possession of personal property collateral, (iii) a variety of other, less commonly used pre-judgment remedies, (iv) the statutory requirements and procedures for obtaining appointment of a receiver in a state court proceeding and (v) select issues relevant to appointment of a receiver in a federal court proceeding.
