Litigation Members Highlighted for Role in Appellate Case

Charlotte Litigation Members Tom MyrickMark Nebrig and Jonathan Watkins were highlighted in North Carolina Lawyers Weekly’s (NCLW) front-page article "Read the Fine Print," for their role in Knox v. First Southern Cash Advance.  MVA served as lead counsel for all defendants on appeal.  Before the trial court, MVA had served as lead counsel for certain defendants and local counsel for other defendants. 

The article, which published on February 17, overviewed the impact of the N.C. Court of Appeals’ unanimous ruling that the trial court erred in certifying a class action involving more than $150 million in claims for payday lending.  The Court of Appeals vacated the trial court’s rulings and remanded the case for individual arbitration.  The ruling can be seen here.

Myrick and Nebrig told NCLW that the appellate court’s decision would provide clarity for both businesses and consumers.

“’I think both sides have an understanding that an arbitration agreement in consumer contracts is going to be followed by the courts.  The words matter, which is important for businesses, to understand that their contracts will be honored as written,’” Myrick stated.
