Jim White understands his legal work has real consequences for the people and businesses he represents and he readies himself to negotiate, aggressively litigate -- and, sometimes, even compromise-- to protect their best interests.  He knows the importance of negotiation and compromise to resolving disputes, but he will also aggressively litigate when it is necessary to do so.

Mr. White practices law to make a difference, whether through his litigation practice at Moore & Van Allen or through his pro bono legal services for Legal Aid of North Carolina, the American Civil Liberties Union and other volunteer avenues.  In 2004, Mr. White provided over 200 pro bono hours toward obtaining reversals for five individuals in a series of employment termination hearings, which included arguments before the North Carolina Employment Security Commission.

In his litigation practice, he handles a broad mix of disputes, ranging from construction law and asbestos litigation defense to consumer finance and lemon law to contract issues.  He has also represented creditors in Bankruptcy matters in both the Middle and Eastern Districts of North Carolina.

Before attending law school, Mr. White worked in the publishing and entertainment industries, as well as for a major international management consulting firm.

Representative Cases

• Mr. White obtained a seven figure judgment for a client in an embezzlement matter, winning on summary judgment, even though all of the defendants asserted their Fifth Amendment rights and refused to take part in the discovery process.

• He successful negotiated a substantial settlement for a client who had a Deed of Trust on a large parcel of land, but faced serious technical difficulties in enforcing it.  He reached a favorable solution through mediation, avoiding the cost of a major legal battle.

• He successfully briefed and argued State v. Foster, 359 N.C. 179, 604 S.E.2d 913 (2004), representing the American Civil Liberties Union Legal Foundation of North Carolina before the North Carolina Supreme Court in a case that helped to preserve the defense of entrapment in criminal cases in North Carolina.
