Author, teacher and frequent speaker on environmental law, Bill White delivers to his national clients creative and sophisticated counsel in transactions and environmental compliance matters, including several ongoing multiparty Superfund issues. 

Former Enforcement Counsel for Superfund at the U.S. EPA Headquarters in Washington, D.C., he has litigated in federal and state courts on numerous environmental and toxic tort issues.

He has represented large and small businesses, lenders, municipalities and the EPA in enforcing and defending civil and criminal cases and administrative proceedings under federal and state environmental laws.  Mr. White has also worked with clients on environmental due diligence, audits, voluntary disclosures and enforcement settlements and consent decrees.

Further, he assists clients in developing and implementing facility-specific and company-wide environmental compliance management systems.  He also investigates and negotiates environmental aspects of domestic and international transactions, including asset sales and purchases, financings, mergers and acquisitions, corporate restructurings and joint ventures.

Mr. White has prepared comments for clients on a wide array of regulatory proposals, and has represented business clients and the EPA with respect to legislative and governmental affairs initiatives.

Representative Cases:

  • United States and States of Alabama, Arkansas, Nebraska, South Carolina, Texas and Utah v. Nucor Corporation (U. S. District Court, District of South Carolina).  Represented Nucor Corporation in negotiating comprehensive consent decree to resolve alleged violations of Clean Air Act, RCRA, Clean Water Act and EPCRA at eight steel mills and six other operating facilities in eight states.
  • Lord Corporation v. Brown & Williamson Tobacco Company, Marathon Oil Company and Ashland Oil Company (U.S. District Court, District of Kentucky, Bowling Green Division).  Represented plaintiff in CERCLA contribution action against prior owners of real estate.
  • U.S. v. Mountain Metal, et. al. ( U.S. District Court, Northern District of Alabama).  Represented generator of lead dross as defendant in CERCLA cost recovery action by United States and contribution action by PRPs performing remedial action.
  • North Carolina Department of Environment and Natural Resources v. National Starch and Chemical Company.  Negotiated Administrative Order on Consent with DENR Waste Division to resolve alleged RCRA violations.
  • ReUse Technology, Inc., Xtra Fill litigation.  Represented company selling coal combustion byproducts for structural fill in numerous cases alleging damage to construction projects in Richmond, VA.
