Kerr’s practice includes all facets of debtor-creditor law including representation of creditors, trustees and parties in interest in bankruptcy cases, representation of lenders in foreclosure and lender liability cases, and representation of clients in a broad array of business disputes.

Kerr has been a Certified Specialist in Bankruptcy and Creditor-Debtor law by the South Carolina Supreme Court since 1995.  He has tried cases to verdict in State Court, Federal Court, Bankruptcy Court, and before the Armed Services Board of Contract Appeals.

In addition to assisting his clients, he has served as a bankruptcy court-appointed custodial trustee for a custodial trust established for the remediation of contaminated property in the Upstate of South Carolina.  Additionally, he has served as a State Court appointed Receiver for failed condominium developments on the South Carolina Coast.

Representative Matters

  • Represented a State Agency creditor in the Chapter 9 bankruptcy filing of a South Carolina Toll Road.
  • Represented an environmental regulatory agency in a Delaware Chapter 11 Bankruptcy proceeding and assisted in securing a 148 Million Dollar settlement to pay for long-term monitoring of a closed hazardous waste landfill  located in South Carolina.
  • Represented a senior secured creditor in cash collateral issues, sale issues, and eventual credit bidding issues in the Chapter 11 case of a South Carolina coastal resort.
  • Appointed Custodial Trustee of a former hazardous waste incinerator site and surrounding property by Order of the Bankruptcy Court for the Southern District of Texas, Houston Division.
  • Appointed Receiver of a 90 unit failed condominium complex and a 54 unit failed condominium complex on the coast of South Carolina by the Circuit Court for Horry County, South Carolina.
