Bo Ketner represents clients at the trial and appellate levels in a wide variety of complex matters, and has experience handling complex commercial disputes, class action defense, government investigations, employment litigation, bankruptcy proceedings and other business cases.  He brings a practical and strategic approach to the representation of plaintiffs and defendants, with a client list that includes major financial institutions and Fortune 500 companies, as well as closely-held businesses.  

Before beginning private practice, Ketner served as a law clerk to the Honorable E. Grady Jolly of the U.S. Court of Appeals for the Fifth Circuit.

Representative Matters

  • Represented online mortgage broker in action against former officer for breach of fiduciary duty. Argued and won decisions on procedural issue related to venue in N.C. Business Court and N.C. Court of Appeals. LendingTree, LLC v. Anderson, 747 S.E.2d 292 (2013).
  • Represented two national mortgage lenders in False Claims Act investigations led by U.S. Department of Justice.
  • Represented appliance manufacturer in products liability putative class action that was dismissed with prejudice before discovery.
  • Represented lender in high stakes qui tam action under False Claims Act.
  • Represented mortgage lender in Rule 2.1 mass action alleging negligence, fraud and civil conspiracy arising from real estate development.  Court granted summary judgment to lender.
  • Defended large non-profit organization in high-visibility breach of contract and discrimination case filed by former President and CEO.
  • Represented defendant general partner on appeal in lawsuit by limited partners for breach of fiduciary duty. Court affirmed dismissal. Gaskin v. J.S. Procter Co., LLC, 196 N.C. App. 447 (2009).
  • Represented employer in putative class action brought by 12 named Plaintiffs/putative class representatives, in which class certification was denied and case was dismissed with prejudice.
