David L. Eades
With extensive experience representing lenders, administrative agents and collateral agents in troubled credits, David Eades chiefly represents creditors in corporate workouts and bankruptcies.
Mr. Eades, who heads Moore & Van Allen's Bankruptcy and Restructuring team, repeatedly has been recognized for his accomplishments in this practice area in Woodward/White Inc.'s 2004-2007 The Best Lawyers in America (Bankruptcy), Business North Carolina magazine's 2004-2008 "Legal Elite” (Bankruptcy), and Chambers USA's 2004-2007 America's Leading Lawyers for Business (Bankrupcy/Restructuring). Bankruptcies
- Centennial Healthcare: Represented co-agent for syndicate of lenders with over $220 million of debt and synthetic lease exposure in Georgia bankruptcy involving multi-state nursing home company, including negotiation of confirmed liquidating chapter 11 plan.
- Crown Pacific: Represented agent for syndicate of lenders with $200 million in exposure in negotiating confirmed creditors' plan for debtor timber company in Arizona bankruptcy court. Prepetition, negotiated major restructure involving significant additional collateral coverage, $78 million pay-down, resolution of difficult intercreditor issues with private placement note holders holding $250 million of senior debt.
- Railworks: Represented agent for lender syndicate holding $200 million in pre-petition debt. Negotiated complex five-facility DIP credit arrangements with chapter 11 rail contractor and its surety, $500,000 monthly adequate protection payments and then negotiated confirmed plan of reorganization in Maryland bankruptcy court.
- TransCare: Represented senior secured lender with $65 million of prepetition exposure to Manhattan ambulance company in connection with confirmed prepackaged debt-for-equity chapter 11 plan in New York bankruptcy court.
- US Airways: Represented agent for syndicate of lenders, including Air Transportation Stabilization Board, under $1 billion prepetition credit facility in connection with all facets of Virginia bankruptcy proceedings of debtor airline.
Workouts
- Consulting: Represented agent for lender syndicate in successful restructuring, reducing $65 million exposure to full payoff of senior debt facility to Florida consulting company.
- Leasing: Represented agent for syndicate of lenders with $100 million of exposure in workout and subsequent refinance of credit facility to California automated teller machine lessor.
- Manufacturing: Represented agent for syndicate of lenders in workout and ultimate full payoff of $500 million exposure to manufacturing conglomerate.
- Telecommunications: Represented agent for syndicate of lenders; through restructures, worked down $100 million exposure to D.C. area telecommunications company to full payoff.
- Trucking: Represented agent for loan syndicate in comprehensive restructure of $100 million in loans to Florida trucking company, involving the procurement of significant additional collateral coverage and the resolution of difficult intercreditor issues with private placement insurance company note holders.
