Facility Siting

The firm represents national commercial and industrial firms in connection with siting of facilities in the Southeast. The team offers counsel to business concerns intending to commence operations in the Southeast, or to relocate existing operations here.  The team offers advice with respect to site selection, federal state and local permitting issues (such as wetlands, waste water, stormwater and air emissions permitting), threatened and endangered species concerns, land use restrictions and zoning laws, entitlements and incentives, brownfields programs, and transportation concerns relating to the establishment of business operations in the region.  The team has participated in the siting of operations in the retail sector, power generation facilities, industrial facilities, metal recycling facilities, and waste disposal operations, among others. 

Recent significant siting matters include:

  • The Bridges at Mint Hill.  The team represents the developers of a large lifestyle center in Mint Hill, North Carolina.  The center will be located near the critical habitat for a listed endangered species, and presented unique permitting and resource protection issues.  The design of the development incorporates state-of-the-art environmental protection measures. 
  • Steel Recycling Facility.  The environmental team worked with several other groups within the firm to obtain all approvals necessary for the development and construction of a major steel recycling facility in rural northeastern North Carolina.  The project required numerous state and local permits, as well as the completion of an environmental assessment pursuant to North Carolina’s Environmental Policy Act.

    All commercial real estate transactions involve some level of environmental risk, regardless of whether the property being transferred was formerly used for industrial, commercial, agricultural, or residential purposes. Accordingly, it is important for a buyer to consider conducting some level of environmental due diligence prior to purchasing real property. Environmental due diligence will allow the buyer to identify and quantify the environmental issues associated with the property.
