Immigration Update

On October 15th, USCIS announced by publication in the Federal Register that they are extending the maximum period of admission for Canadian and Mexican nationals in TN status from one year to three years.

Our NAFTA Treaty with Mexico and Canada provides for TN status for nationals of these countries to live and work in the U.S. temporarily in one of the enumerated occupations. Previously TN status could be granted for a maximum of one year, and requested in one year extensions. In an unprecedented move, the USCIS amended by publication the regulations governing the implementation of the NAFTA treaty and extended the period of initial entry, as well as extensions, from one year to three years. The process for acquiring TN status and filing for extensions has not changed, nor have the education or occupation requirements changed.

If you have any questions regarding the applicability of the new TN period of admission, please call or email your MVA Immigration Team Contact.
