MVA Member and Head of Bankruptcy & Restructuring practice Zach Smith will serve as a Senior Lecturing Fellow at Duke Law for the Wintersession course titled, “Advising a Distressed Enterprise and Its Stakeholders.” This course, to be held in February 2021, will provide students with a practical understanding of the role of outside counsel to a variety of key stakeholders in complex, high-stakes, and fast-paced business reorganizations – including distressed companies and their officers and directors, secured and unsecured creditors, distressed investors, and formal and informal committees.

Additionally, Zach and Bankruptcy & Restructuring Member Alan Pope (also a Senior Lecturing Fellow) will co-teach the spring semester course titled, “Structuring and Regulating Financial Transactions.” The principles applied in structuring financial products in the commercial context reflect a balance of the interests of corporate stakeholders and the rights of third parties. This course will examine these principles with the goal of equipping the student with a base of knowledge that would be readily applied in a finance practice of a commercial law firm.
