Moore & Van Allen Litigation Member Tom Myrick was quoted in the Law360 article titled, “Justice Breyer On State Tax: Key Moments To Know” which was published on January 28. The article discusses how Justice Stephen Breyer, who announced Thursday that he would retire at the end of the U.S. Supreme Court's current term, made a distinctive mark on several key state tax cases heard by the court. One specific case mentioned was that of North Carolina Department of Revenue v. Kimberley Rice Kaestner 1992 Family Trust in which Tom represented the Kimberley Rice Kaestner Family Trust.

"But that isn't what you want to tax," Justice Breyer said. "Moreover, we don't even know if she'll ever get the money. Now there's something wrong with that."

One of the attorneys for the trust told Law360 that the moment was memorable. The sentiment expressed by Justice Breyer was taken from briefs the trust filed with the North Carolina Court of Appeals and the North Carolina Supreme Court, Thomas D. Myrick, partner at Moore & Van Allen PLLC, told Law360.

"When Justice Breyer said those words, everyone on our side took a sigh of relief and sat back in our chairs," Myrick said. "One can never know what direction the SCOTUS will go, but that's when we knew he was on our side. As it turns out, they all were."
