During oral arguments June 4, the 9th U.S. Circuit Court of Appeal’s identification of strengths and weaknesses on both sides of the case offered few clues about the court’s potential ruling in youth’s suit seeking federal action on climate change. 

Moore & Van Allen partner Peter McGrath, who is not involved in this case, says "Ultimately, the government's strategy does not rest on prevailing in this appeal. I think the government believes it can prevail in the U.S. Supreme Court because it views the court's prior orders in this case as well as the decision in American Electric Power Co. v. Connecticut, 564 U.S. 410 (2011), as signals that the court will not allow this case to go forward".
