Charlotte Bankruptcy Member Zach Smith served as a contributing author in the International Comparative Legal Guide to: Lending & Secured Finance 2017 which covers common issues in lending and secured finance laws and regulations – including guarantees, collateral security, financial assistance, syndicated lending/agency/trustee/transfers and withholding, stamp and other taxes– in 41 jurisdictions. Smith’s chapter discusses the key elements of the section 363 sales process such as lender expectations and questions in 363 sales process negotiations, and payment of certain claims at the 363 stage and outside of a chapter 11 plan.
