Taylor Quoted in Christian Science Monitor

04.2012

Commercial and Technology Transactions senior counsel Todd Taylor was quoted in The Christian Science Monitor’s April 11 article entitled “Facebook passwords:  why companies don’t use them to see your posts.”  The article addresses the controversy surrounding employers’ practice of asking for job applicants’ social media passwords.  There is pending legislation in at least five states prohibiting the practice.

Taylor remarks that once such access is requested, “you are on notice for anything that you might find.”  He advises against pursuing information that is not already public, because otherwise, “if you see something and you don’t act on it, you have the potential issue of a negligent hire down the road.”
