MVA Secures Confirmation of Client’s Complete Dismissal in ERISA Litigation

Moore & Van Allen (MVA) Co-Head of Litigation Mark Nebrig and Litigation Counsel Drew Newman recently secured confirmation that all claims against their client—the former CEO of Norco, Inc. —will remain dismissed in an action brought by the Department of Labor (DOL) for alleged ERISA violations in connection with the sale of Norco stock. After the MVA team obtained the client’s dismissal from the litigation in November 2024, the DOL moved the court to reconsider that decision. On Tuesday, the U.S. District Court for the District of Idaho denied the DOL’s motion, confirming this successful outcome for the client.
