Stukes, Callisto and Werner Analyze Evolving PFAS Regulatory Landscape

Moore & Van Allen attorneys Mary Katherine Stukes, Gianna Callisto and Pierce Werner recently authored an article for The Daily Report examining the evolving regulatory landscape for per- and polyfluoroalkyl substances (PFAS), often referred to as “forever chemicals.”

The article explores how recent federal actions have created a complex and, at times, inconsistent framework. While the U.S. Environmental Protection Agency has rolled back certain drinking water standards, it continues to maintain key designations for PFOA and PFOS and advance additional PFAS-related initiatives.

At the same time, states are taking a more active role. North Carolina, in particular, highlights the challenges of regulating PFAS amid federal uncertainty, including new groundwater standards and more flexible approaches to surface water discharges.

The authors outline practical implications for businesses, including enforcement activity, litigation risk and the importance of understanding PFAS usage across operations. Despite shifts at the federal level, the broader trend remains clear: PFAS regulation is evolving, not disappearing.
