Pierce Werner represents entities, businesses, and industries across the full spectrum of environmental legal issues in the many varying contexts in which they arise. He has experience with complex environmental litigation, and regulatory enforcement and compliance actions at the local, state, and federal level, as well as transactional environmental due diligence, Brownfields redevelopment, environmental permitting.

Overview

Pierce’s litigation experience includes representation of clients in both simple and complex matters before civil and administrative courts of law. Pierce has been involved in cases involving toxic torts, environmental contamination, citizen suits, and emerging contaminants.

Pierce has counseled industrial and manufacturing clients in matters of environmental health and safety and regulatory compliance involving a broad range of environmental statutory and regulatory schemes, including: the Clean Water Act, Clean Air Act, RCRA, CERLCA, TSCA, EPCRA, FIFRA, SC Mining Act, and the Federal Power Act. Pierce has also represented clients on many of these areas in the context of enforcement actions before various agencies, including: NCDEQ, SCDHEC, EPA, DOJ, and state and federal OSHA.

Representative Experience

  • Representation of a company integrally involved in the current Multi-district Aqueous Film-forming Foam (AFFF) litigation related to PFAS contamination across the United States
  • Conducted environmental due diligence associated with the total asset purchase of a regional petroleum distribution company with over a hundred gas stations and cardlock fueling facilities
  • Represented self-storage facility in multi-year stormwater permitting dispute with SCDHEC before administrative law court
  • Defended a chemical manufacturing facility in complex CAA enforcement action brought by EPA and DOJ
  • Represented multiple large gun ranges in federal OSHA enforcement actions resulting in significant reductions or complete dismissal of violations and penalties
  • Counseled clients in multiple PRP Groups for Superfund sites during crucial phases, including liability allocation and finalization and implementation of consent decrees
  • Assisted mining company with navigating local zoning ordinances and disputes with county for proposed sand-mining operation
  • Represented concrete company in CWA enforcement action brought by EPA related to facilities in North and South Carolina
