Moore & Van Allen’s (MVA) Co-head of Privacy & Data Security, Karin McGinnis, and Litigation Associate, Jules Carter, co-authored the article, “Unique Aspects Of Texas’ Approach To AI Regulation”, published by Law360.
Their article provides an overview of the Texas Responsible Artificial Intelligence Governance Act, which takes effect January 1, 2026 and establishes a uniquely narrow, innovation-focused approach to AI regulation. Unlike broader frameworks in the EU and Colorado, the Texas law imposes limited obligations on private-sector businesses, concentrates on government and healthcare transparency, strengthens biometric data protections, adopts an intent-based standard for AI-related discrimination, and introduces a regulatory sandbox designed to encourage responsible testing and development.
