Moore & Van Allen Secures $190 Million Judgment for Ardagh in Complex Commercial Jury Trial in Chicago Federal Court
Moore & Van Allen won a judgment of more than $190 million on behalf of its client Ardagh Metal Packaging USA Corp. following a two-week jury trial against America Craft Brewery LLC in the United States District Court for the Northern District of Illinois.
The strong outcome follows four years of litigation of a complex dispute in which both parties claimed breach of a long-term supply agreement. The jury decided issues of contract interpretation, contract performance, and Ardagh's right to lost profits, among other issues. The Moore & Van Allen team was led by Chris Tomlinson and Jim McLoughlin, and the Ardagh team was led by Joshua Markus, Vice President & General Counsel, North America and Andrea Gilroy, Senior Legal Counsel.
The significant judgment includes more than $175 million in damages awarded by the jury and over $15 million in prejudgment interest.
